ARM CUSTOM STONE, Inc. Terms and Conditions

These Terms & Conditions apply to all purchases, orders, estimates, deliveries, pickups, samples, and product inquiries involving ARM Custom Stone (“ARM Custom Stone,” “ARM,” “we,” “our,” or “us”). By placing an order, accepting delivery, picking up products, approving an estimate, or purchasing products from ARM Custom Stone, the customer (“Customer,” “Buyer,” or “you”) agrees to the following terms.
Payment Due
Payments are due upon order completion unless otherwise agreed to in writing by ARM Custom Stone. An order is considered complete when the order is ready for pickup, ready for delivery, or was requested to be ready for pickup or delivery, whichever occurs later.
Orders must be picked up or delivered within two weeks of completion unless otherwise approved in writing. Orders left beyond this period may be subject to storage fees, handling fees, or other applicable charges.
Established accounts with approved written credit terms must pay according to the terms stated in their credit agreement. Unless otherwise stated in writing, approved account balances are due within 30 days of order completion.
Return Policy
Acceptance of any return, exchange, refund, or credit is at the sole discretion of ARM Custom Stone.
To be considered for a return, refund, or adjustment, you must notify ARM Custom Stone in writing of any shortages, visible damage, incorrect products, or other issues no later than the first business day following delivery or pickup.
Because many ARM Custom Stone products are custom, handmade, cast, colored, textured, specially ordered, or produced in batches, variations in color, shade, texture, size, thickness, finish, surface details, and natural appearance are expected and are not considered defects.
Special orders, custom orders, made-to-order products, discontinued products, clearance items, opened pallets, partial pallets, installed products, used products, damaged products, and products altered after pickup or delivery are non-refundable.
Regularly stocked products may be considered for return only if they are unused, undamaged, in full pallet or full package quantities, and returned within 14 days of purchase. Approved returns may be subject to a restocking fee.
No returns will be accepted more than 90 days after product receipt.
Packaging Fees, Pallets, and Crates
A non-refundable packaging, pallet, crate, or handling fee may be included with orders. This fee may include labor, pallets, crates, foam, strapping, wrapping, plastic, loading materials, and other materials used to safely package and prepare the order.
Custom fabrication orders, special orders, fragile products, heavy products, or orders requiring additional protection may be subject to additional packaging or handling fees.
Quantities, packaging needs, pallet counts, and handling charges may be estimated at the time of sale and updated when the order is completed or prepared for delivery.
Proposals, Estimates, and Pricing
Written proposals and price estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Prices are subject to change without notice due to changes in material cost, labor, freight, supplier pricing, fuel, availability, production cost, or other market conditions.
Unless specifically stated in writing, prices do not include delivery, freight, handling, installation, taxes, special packaging, storage, unloading, or additional services.
Any discount, sale price, special price, or closeout price is valid only if provided in writing by ARM Custom Stone.
Sales tax will be charged on all applicable purchases unless a valid resale certificate or tax exemption certificate is provided and accepted before the transaction is completed.
Samples, Images, and Product Displays
Product images on our website, social media, catalogs, advertisements, samples, and marketing materials are provided for general reference only.
We strongly recommend viewing products in person before making a final purchase decision. Photos, renderings, screen displays, printed materials, lighting conditions, and sample pieces may not accurately represent the final product color, shade, texture, finish, or appearance.
ARM Custom Stone products may include natural and handmade variation. Color, finish, texture, thickness, surface pattern, edge detail, and other characteristics may vary between samples, batches, displays, and final delivered products.
Samples are provided with the understanding that variation is inherent in the product and is not considered a defect.
Order Coverage and Quantity Estimates
ARM Custom Stone may provide estimates of square footage, linear footage, pallet coverage, unit quantities, material needs, or project quantities. These estimates are provided for general planning purposes only and are not guarantees.
The customer is responsible for verifying measurements, quantities, project requirements, installation needs, waste factors, cuts, breakage, site conditions, and final material requirements before ordering.
ARM Custom Stone is not responsible for shortages, overages, installation delays, or costs resulting from inaccurate measurements, inaccurate project information, or coverage estimates.
Payments, Late Fees, and Invoice Disputes
ARM Custom Stone may accept cash, checks, credit cards, debit cards, wire transfers, money orders, electronic payments, or other approved payment methods.
Returned checks may be subject to a returned check fee of $35 or the maximum amount allowed by law.
Credit card, debit card, wire, or electronic payment processing fees may apply where permitted by law and will be disclosed when applicable.
If you believe there is an error on an invoice, you must notify ARM Custom Stone in writing within 7 business days of the invoice date. Failure to dispute an invoice within this period may be considered acceptance of the invoice.
Past due balances may be subject to late fees, interest, collection costs, and reasonable attorney fees where permitted by law.
Delivery
ARM Custom Stone may deliver products directly or through third-party carriers, freight companies, couriers, or delivery services.
The customer is responsible for providing accurate delivery information, including address, contact person, phone number, site access instructions, gate codes, unloading instructions, and any known delivery restrictions.
Unless otherwise agreed in writing, delivery will be made to the most accessible safe location at or near the project site, driveway, curbside, or public right-of-way. Delivery does not include installation, moving materials inside the property, carrying materials upstairs, job-site placement, or special unloading unless specifically agreed to in writing.
The customer is responsible for ensuring that the delivery location is safe, accessible, and suitable for trucks, forklifts, pallet jacks, or other delivery equipment.
ARM Custom Stone is not responsible for damage to driveways, walkways, landscaping, underground utilities, irrigation, gates, curbs, sidewalks, pavers, or other property during delivery when delivery is made according to customer direction or site conditions.
By accepting delivery, you agree to hold ARM Custom Stone harmless from claims, damages, or disputes related to delivery location, access, unloading, or site conditions.
Pickup and Loading
Customers picking up products are responsible for bringing a suitable vehicle, trailer, straps, tie-downs, padding, and securing materials safely.
ARM Custom Stone may assist with loading as a courtesy. By allowing ARM Custom Stone to load your vehicle or trailer, you acknowledge that you are responsible for inspecting the load, securing the load, and determining whether your vehicle or trailer is suitable for the weight and size of the products.
ARM Custom Stone is not responsible for damage to vehicles, trailers, products, or property during loading, transport, or unloading once products have been released to the customer or the customer’s agent.
Product Disclaimer
ARM Custom Stone products may include custom stone, concrete, cast stone, pavers, tiles, curb stones, wall panels, veneers, decorative stone products, architectural pieces, and related materials.
By purchasing products from ARM Custom Stone, you acknowledge that these products may vary in color, texture, finish, tone, pattern, density, thickness, size, surface detail, and appearance. Such variations are normal and are not defects.
Products may chip, crack, stain, fade, weather, oxidize, discolor, effloresce, absorb moisture, develop surface variation, or otherwise change over time depending on installation, use, exposure, maintenance, climate, drainage, sealers, chemicals, traffic, impact, or environmental conditions.
The customer is responsible for selecting products suitable for the intended project, location, design, and use.
Design, Installation, and Maintenance
Unless specifically agreed to in writing, ARM Custom Stone does not provide design, engineering, architectural, installation, construction, or maintenance services.
Customers are responsible for hiring qualified contractors, installers, designers, architects, engineers, or other professionals as needed.
Proper installation is critical to product performance. Outdoor installations should consider slope, drainage, substrate, base preparation, expansion, contraction, joint spacing, sealers, climate, waterproofing, traffic loads, and local building requirements.
Improper installation, improper base preparation, poor drainage, movement, excessive heat, freeze/thaw conditions, structural issues, chemical exposure, impact, or lack of maintenance may cause cracking, staining, movement, deterioration, or other damage.
ARM Custom Stone is not responsible for installation issues, site conditions, contractor work, design decisions, maintenance failures, or product performance caused by improper use or installation.
Customers should avoid harsh chemicals, acid-based cleaners, de-icing products, abrasive cleaners, or improper sealers unless approved by a qualified professional for the specific product and application.
Disclaimer and Limitation of Liability
ARM Custom Stone makes no express or implied warranties unless specifically provided in writing.
To the maximum extent permitted by law, ARM Custom Stone disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, suitability for a specific use, and non-infringement.
ARM Custom Stone shall not be liable for indirect, incidental, consequential, special, punitive, compensatory, or other damages, including but not limited to labor costs, installation costs, removal costs, replacement costs, lost profits, project delays, business interruption, or damage to property.
In no event shall ARM Custom Stone’s total liability exceed the amount paid by the customer to ARM Custom Stone for the specific products or order giving rise to the claim.
Waiver and Indemnification
By accepting products from ARM Custom Stone, you agree to waive claims related to normal product variation, product selection, installation, maintenance, site conditions, delivery access, loading, unloading, and product performance after pickup or delivery.
You agree to indemnify, defend, and hold harmless ARM Custom Stone, its owners, employees, contractors, suppliers, and representatives from any third-party claims, disputes, damages, losses, liabilities, costs, or expenses arising from your purchase, installation, use, resale, delivery, handling, or modification of ARM Custom Stone products.
ARM Custom Stone is not responsible for products once they have been delivered, picked up, installed, modified, handled by third parties, or stored outside ARM Custom Stone’s control.
Delays and Force Majeure
ARM Custom Stone is not responsible for delays or failure to perform caused by events beyond its reasonable control, including but not limited to material shortages, supplier delays, labor shortages, transportation delays, equipment failure, weather, natural disasters, fire, accidents, illness, epidemic or pandemic conditions, government orders, utility failures, civil unrest, war, terrorism, or other unforeseen circumstances.
If such an event occurs, ARM Custom Stone will make a good faith effort to complete or reschedule the order as reasonably possible.
Pre-Lien Notice
Some projects may be subject to California mechanic’s lien laws. Any person or company supplying labor, services, equipment, or materials for an improvement to real property may have lien rights if they are not paid.
Customers are encouraged to consult with a qualified California attorney, contractor, or legal professional regarding lien rights, lien waivers, notices, and payment obligations related to construction projects.
Dispute Resolution, Jurisdiction, and Venue
The parties agree to make good faith efforts to resolve disputes informally before pursuing legal action.
Unless otherwise required by law, any dispute arising from or relating to an order, estimate, invoice, product, delivery, pickup, or these Terms & Conditions shall be governed by the laws of the State of California.
Venue and jurisdiction shall be in the state or federal courts serving Los Angeles County, California, unless otherwise required by applicable law.
Changes to These Terms
ARM Custom Stone may update or modify these Terms & Conditions at any time. The version posted on our website or provided at the time of sale will apply to the applicable transaction unless otherwise agreed in writing.
